These Terms govern use of NerdFax's fax-sending service, available both without an account (anonymous, one-time sends) and with a NerdFax account. By using the service, you agree to these Terms.
NerdFax transmits documents by fax on your behalf to a fax number you provide, and provides a record of that transmission (a “trace”). NerdFax does not review, endorse, or take responsibility for the content of documents you send.
Fees are disclosed before you pay. For a one-time fax, your card is authorized but only charged after NerdFax's records show the fax was successfully delivered; if delivery is not confirmed, the authorization is released rather than charged. Accepted payment methods are limited to card, Apple Pay, and Google Pay. NerdFax does not currently offer refunds for successfully delivered faxes, since payment is only ever taken after confirmed delivery in the first place; if you believe you were charged in error, contact us (Section 10) and we will look into it.
A Business Fax Number subscription is billed automatically each month, starting immediately at signup, until you cancel. If you cancel, your subscription stays active through the end of the billing period you already paid for, and the number is released — not preserved for you — once that period ends. NerdFax does not offer refunds for a subscription period already billed. Pages sent beyond your plan's included allowance are billed at the posted per-page overage rate.
Creating an account is optional. If you create one, you are responsible for maintaining the security of your login and for all activity under your account. A one-time fax sent without an account can later be claimed by an account you create or sign into, as described in the product itself.
NerdFax relies on third-party telecommunications and payment providers to deliver its service and does not guarantee uninterrupted availability. NerdFax does not currently offer a service-level agreement (SLA).
NerdFax is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Fax transmission depends on third-party telephone networks and equipment outside NerdFax's control, and NerdFax does not guarantee that any fax will be deliverable at all times. To the maximum extent permitted by law, NerdFax's total liability for any claim arising from your use of the service is limited to the amount you paid NerdFax for the fax giving rise to the claim.

In short: NerdFax's Business Fax Number product supports HIPAA-regulated workflows — Business Associate Agreements are in place with our infrastructure and fax-transport providers, and a customer executes their own BAA with NerdFax directly from their account before sending or receiving protected health information. The anonymous, one-time send flow is not intended for PHI.
We may update these Terms from time to time. If we make a material change, we will update the effective date above. Continued use of NerdFax after a change takes effect means you accept the updated Terms.
